Abstract:
Дослідження кваліфікаційної наукової роботи присвячено комплексному аналізу теоретико-правових, історичних та організаційно-технічних засад евакуації та збереження культурних цінностей у разі збройного конфлікту. Особлива увага приділена осмисленню досвіду України в період військової агресії 2014-2025 років. У роботі проаналізовано міжнародну нормативно-правову базу, зокрема положення Гаазької конвенції 1954 року та її Протоколів. Виявлено, що, незважаючи на міжнародні зобов’язання, до 2022 року в Україні існували системні прогалини у превентивному плануванні та організаційно-технічній готовності до масової евакуації культурних цінностей. Розкрито сутність історичного досвіду евакуації, а також детально проаналізовано сучасні методи пасивного збереження та роль цифрових технологій як важливого інструменту віртуального збереження та документування втрат. Здійснено аналіз досвіду України у 2022-2025 роках, який підтвердив необхідність єдиної системи обліку, браку спеціалізованих сховищ та загострення проблеми незаконного примусового переміщення цінностей окупаційними силами. У результаті дослідження розроблено практичні рекомендації для вдосконалення законодавства України щодо збереження культурних цінностей.

The research of the qualifying scientific paper is devoted to a comprehensive analysis of the theoretical and legal, historical, and organizational-technical principles for the evacuation and preservation of cultural property in the event of armed conflict. Particular attention is paid to understanding Ukraine's experience during the period of military aggression from 2014 to 2025. The master's thesis analyzes the international regulatory framework, particularly the provisions of the 1954 Hague Convention and its Protocols. It was found that, despite international obligations, systematic gaps existed in Ukraine before 2022 in preventive planning and organizational-technical readiness for the mass evacuation of cultural property. The essence of the historical experience of evacuation is revealed, and a detailed analysis of modern methods of passive preservation and the role of digital technologies as a important tool for virtual preservation and documentation of losses is provided. The analysis of Ukraine's experience in 2022-2025 was carried out, which confirmed the need for a unified accounting system, the lack of specialized repositories, and the aggravation of the problem of illegal forced displacement of
property by occupying forces. As a result of the research, practical recommendations for improving Ukraine's legislation regarding the preservation of cultural property were developed.
