Abstract:
Робота присвячена порівняльно-правовому аналізу регулювання ввезення/вивезення культурних цінностей до ЄС за Регламентом (ЄС) 2019/880 та можливостей його імплементації в Україні у сегменті об’єктів палеонтологічного інтересу. Актуальність дослідження зумовлена водночас зростанням міжнародного інтересу до геонаукової спадщини України та необхідністю узгодження національної системи охорони, експертизи й обігу культурних цінностей із вимогами Регламенту (ЄС) 2019/880. Значна частина палеонтологічних матеріалів, які циркулюють у музеях, приватних збірках і наукових інституціях, не мають чітко визначеного правового статусу, що створює прогалини у митних процедурах, експертизах та міжнародному науковому обміні. У роботі представлено огляд слабких місць чинної української нормативної бази, зокрема нечіткість розмежування понять «культурний предмет» і «культурна цінність», відсутність механізмів для фіксації ступеня наукової значущості, нерозвиненість інструментів міжвідомчої комунікації між МКІП, НАН України, музеями та митними органами. Окрему увагу приділено аналізу ключових положень Регламенту (ЄС) 2019/880, що регулює імпорт культурних цінностей до країн ЄС, та визначенню шляхів його імплементації у вітчизняну законодавчу систему з мінімізацією бюрократичного навантаження для наукових інституцій.

The work is devoted to a comparative legal analysis of the regulation of importation of cultural valuables into the EU under Regulation (EU) 2019/880 and the possibilities of its implementation in Ukraine in the segment of paleontological objects of interest. The relevance of the study is driven both by the growing international interest in Ukraine's geoscientific heritage and the need to align the national system of protection,
expertise, and circulation of cultural valuables with the requirements of Regulation (EU) 2019/880. A significant portion of paleontological materials circulating in museums, private collections, and scientific institutions lack a clearly defined legal status, which creates gaps in customs procedures, expert assessments, and international scientific exchange. The work presents an overview of the weaknesses in the current Ukrainian regulatory framework, notably the unclear distinction between the concepts of «cultural object» and «cultural valuable», the absence of mechanisms for recording the degree of scientific significance, and the underdevelopment of interagency communication tools between MCU, NAS of Ukraine, museums, and customs authorities. Special attention is given to the analysis of key provisions of Regulation (EU) 2019/880, which regulates the import of cultural valuables into EU countries, and the determination of ways to implement it into the domestic legislative system with minimal bureaucratic burden on scientific institutions.
